Consortium Services Agreement

1. Purpose

   This agreement establishes the terms under which goMDnow will provide random drug testing consortium services and Medical Review Officer (MRO) services to the Owner-Operator named above, ensuring compliance with the Federal Motor Carrier Safety Administration (FMCSA) regulations under 49 CFR Part 40 and Part 382.

2. Services Provided

   goMDnow agrees to provide the following services in compliance with 49 CFR Part 40 and 49 CFR Part 382:

   • Enrollment in goMDnow's DOT Testing Consortium.
   • Immediate Consortium Compliant Certificate.
   • Quarterly Random Selections for drug and alcohol testing as required by FMCSA.
   • Notification of testing selections and coordination of testing appointments.
   • Lab-based DOT urine drug testing and evidential breath alcohol testing at SAMHSA-certified collection sites.
   • MRO review and reporting of all laboratory drug test results to the Owner-Operator.
   • Reporting violations in the FMCSA Clearinghouse.
   • Compliance support for audits.

3. Responsibilities of Owner-Operator

   The Owner-Operator agrees to:

   • Enroll in the goMDnow Random Drug Testing Consortium.
   • Ensure that all employees subject to FMCSA regulations participate in the random drug testing program.
   • Comply with all FMCSA drug and alcohol testing requirements.
   • Accept and act upon MRO-approved results as delivered by goMDnow.
   • Maintain accurate records of drug and alcohol testing compliance.

4. Compliance with Federal Regulations

   goMDnow and the Owner-Operator agree to comply with all applicable federal regulations, including but not limited to:

   • 49 CFR Part 40 – Procedures for Transportation Workplace Drug and Alcohol Testing Programs
   • 49 CFR Part 382 – Controlled Substances and Alcohol Use and Testing (FMCSA)
   • Any additional guidance or amendments issued by FMCSA or DOT

5. Pricing and Fees

   Note: All prices are in USD. Rates are subject to change. Any change in pricing will be communicated in writing, with at least 30 days’ notice, and will take effect upon receipt of such notice.

6. Medical Review Officer (MRO) Services

   All drug testing results will be reviewed and verified by a qualified and licensed MRO affiliated with goMDnow. The MRO’s final determination will be delivered directly to the Owner-Operator and maintained for recordkeeping by 49 CFR Part 40 Subpart G.

7. Term and Termination

   This Agreement shall remain in effect for 12 months from the effective date and will automatically renew annually unless either party provides written notice of cancellation 30 days prior to renewal.

8. Confidentiality

   All records and communications related to testing and results will be handled with strict confidentiality in compliance with DOT regulations.

9. Entire Agreement

   This Agreement represents the entire understanding between the parties and supersedes any previous agreements. Modifications must be made in writing and signed by both parties.

10. Governing Law

    This agreement shall be governed by and construed in accordance with the laws and regulations of the FMCSA and the Department of Transportation (DOT).
