DOT Supervisor Training & Documentation Requirements

For DOT-regulated employers, reasonable suspicion testing must be ordered by a trained supervisor. Under 49 CFR Part 382, supervisors who make reasonable suspicion determinations must complete specific training.

DOT supervisor training (required) At least 60 minutes on alcohol misuse signs and symptoms, and at least 60 minutes on drug use signs and symptoms — a total of at least 2 hours of training per supervisor who makes reasonable suspicion determinations.
Valid observation categories Appearance (bloodshot eyes, unusual pupil size), behavior (erratic or aggressive conduct), speech (slurred or incoherent), body odor (alcohol, marijuana), or impaired coordination and motor skills.
Documentation before testing Supervisors must document specific, contemporaneous observations in writing before directing the employee to test. Documentation must be completed within 24 hours or before results are released.
Employee cannot refuse A DOT safety-sensitive employee who refuses a supervisor-directed reasonable suspicion test is treated as a positive result — they must immediately stop safety-sensitive functions and begin the RTD process.

Act quickly: For alcohol reasonable suspicion testing, the test must be completed within 2 hours of the supervisor's determination (and no later than 8 hours). If not completed within 2 hours, the employer must document why. After 8 hours, alcohol testing is no longer permitted for that incident.
