DOT Post-Accident Testing Timing Requirements

For DOT-regulated employers, post-accident testing is triggered by specific accident criteria and must be completed within strict time windows. Missing these windows can compromise compliance.

Alcohol test
2 hrs
Must be completed within 2 hours of the accident. If not done within 2 hours, document why. Testing is prohibited after 8 hours.
Drug test
32 hrs
Must be completed within 32 hours of the accident. If not done in time, document why and stop the attempt. Results cannot be substituted.

DOT post-accident testing is triggered when a CMV accident involves any of the following:

Critical: The driver must not consume alcohol for 8 hours following the accident, or until a post-accident alcohol test is completed — whichever comes first. An employer who allows a driver to consume alcohol before testing may be found non-compliant during an FMCSA audit.
